Can unmarried man be charged domestic violence in assault on girlfriend?

This is what happens as a result of the DOMA law. This man DID assault his live-in girlfriend and is trying to get out of it on a technicality that we all saw coming because Ohio voters approved the Defense of Marriage Amendment.
